IMPORTANT UPDATE: DORS 2020 Overpayment Recoupment

One year ago, the State of Illinois made a terrible error and overpaid Personal Assistants during the Mar 1 to Mar 15, 2020 pay period, which was reflected on paychecks April 13, 2020.

This was in the midst of the global pandemic as PAs were deemed essential workers and asked to continue serving our consumers during the state shutdown, risking our own health and safety.

When our union was made aware of this grave mistake, we immediately demanded that this overpayment be classified as a one-time hazard pay payment to acknowledge the critical roles PAs were playing in a time of crisis for our communities.

We met several times to try and reach an agreement for hazard payment, but the State refused and legally have an obligation to recoup the overpayments.

Our union then pivoted to work to minimize the impact and financial hardship this would create for members, and you should have recently received letters from the state communicating their recoupment plans.

This error by the State is unacceptable and as a union we remain committed to continue to fight for higher wages and better benefits for all Personal Assistants, whether serving on the frontlines during a pandemic or not. And we will continue to pressure the State to establish protocols so that mistakes like this do not ever happen again.

You should have received a letter from the State notifying you of this overpayment and the steps they will take to recoup this overpayment amount. You will also get a letter after each recoupment letting you know the amount that will be deducted from the next check.

If you are no longer working as a Personal Assistant, the State has informed us that at a later date (likely this summer) they will work with the DHS Bureau of Collections (BoC) for all un-collected funds. This will include PAs who no longer work for the program. Once this occurs, the BoC will reach out to each PA and they will arrange repayment agreements individually. Providers can choose how much to pay each month, but they have to repay the full amount within 3 years.

Luego, nuestro sindicato se puso a trabajar para minimizar el impacto y las dificultades financieras que esto crearía para los miembros, y usted debería haber recibido recientemente cartas del estado comunicando sus planes de recuperación.

Este error del Estado es inaceptable y como sindicato seguimos comprometidos a seguir luchando por salarios más altos y mejores beneficios para todos los asistentes personales, ya sea que presten servicio en primera línea durante una pandemia o no. Y seguiremos presionando al Estado para que establezca protocolos para que errores como este no vuelvan a ocurrir jamás.

Debería haber recibido una carta del Estado notificándole de este pago en exceso y los pasos que tomarán para recuperar el monto del pago en exceso. También recibirá una carta después de cada recuperación en la que se le informará la cantidad que se deducirá del próximo cheque.

Si ya no trabaja como asistente personal, el estado nos ha informado que en una fecha posterior (probablemente este verano) el estado trabajará con la Oficina de Cobros (BoC) del DHS para todos los fondos no cobrados. Esto incluirá a los Asistentes Personales que ya no trabajan para el programa. Una vez que esto ocurra, el BoC se comunicará con cada Asistentes Personales y organizará acuerdos de pago individualmente con cada Asistentes Personales. Los Asistentes Personales pueden elegir cuánto pagar cada mes, pero deben reembolsar el monto total en un plazo de 3 años.
